Council takes gamble on marina
BUILDING work is to start in February on Whitby's £2.8m marina development despite the case being referred to the Ombudsman.
Objectors say Scarborough Council, which gave permission for the project, should put a stop to work until the local government watchdog has decided whether or not the public were properly involved in the planning process.
John Riby, Scarborough Council's head of engineering and harbours, said the council is contributing £1.3m while £600,000 of funding from Yorkshire Forward and £900,000 from the European Regional Development Fund has also been secured.
But if the Ombudsman decides the public consultation was not carried out correctly the money could have to be refunded.
However, Mr Riby said councillors decided the risks were manageable and they are working on the basis the Ombudsman will find the council acted appropriately and so have put the work out to tender.
It means work will begin on the 40 new pontoons in February while work on the water resource centre and environmental improvements will start in April.
But Whitby and District Tourism Association (WDTA) and The Marina Development Action Group fear the town will be plunged into chaos during the tourist season and believe as many as 70 car parking spaces could be lost while the work is under way.
John Freeman, of the WDTA and chairman of Stop the Marina Development Action Group, said: "It's absolutely appalling and shows the arrogance of the council to not have the humility to wait until it has been judged because it has another agenda far bigger than the marina.
"The council is taking an enormous risk. It's going to be absolute chaos this summer."
The WDTA believes the long-term plan for Scarborough Council is to develop the whole of the marina which is why they are rushing ahead with the project.
Diana Jeuda, of the marina action group, said the move by the council was a "travesty of local democracy" and said the council had used the pretext that work was due to begin in July as an excuse to "rush" the consultation.
Mr Riby denied the council had plans to develop the marina for housing under this scheme and said Endeavour Wharf will remain a cargo wharf for the foreseeable future.
He also said the council will consult with the relevant bodies on the issue of car parking and said no parking spaces will be lost in the final scheme.
Bob Stay, assistant ombudmsan for the team investigating the issues at Whitby, said if they find the council has behaved improperly they do not have the power to stop the work and added the council is entitled to start the project while they are looking into the case.
He told the Whitby Gazette: "We can't turn the clock back, the thing has got planning permission. It can only be taken away by the courts."

ALEX BENNETT ANNOUNCES NEW YACHTING CAMPAIGN AND MAJOR SPONSOR
International yachtsman Alex Bennett is proud to announce a major new yachting campaign supported by a sponsorship deal with the Graphic Systems division of FUJIFILM UK Ltd.
The new campaign is built around an exciting new sponsorship deal involving the construction of a new racing yacht to compete in major oceanic shorthanded races such as the 2007 Transat Jacques Vabre and Single-handed Transatlantic race in 2009. The new yacht is being designed by the Owen Clarke Design Group specifically to conform to the new French Class 40 Rule (see www.class40.com for more info)
The state of the art forty foot boat is being built in the United Kingdom in the West-Country and will take to the water in June 2007 in preparation for an exciting three year campaign.
Thirty year old Bennett said, “Things are going great. We are now three months into the construction of the new boat.. Fujifilm’s backing and support means we can now give this project the true focus and commitment it deserves. We have a great design of boat here and it’s taking shape day by day. I just can’t wait to get sailing again as we certainly have exciting times ahead.

West county based Alex is one of a new breed of competitive professional yachtsman. In 2001 Alex won the Open 50 division of the prestigious Transat Jacques Vabre race, setting a new course record in the process which he still retains.
In 1999 Alex competed in the Solo Mini Transatlantic race, achieving the best British Result in the 20 year history of the event coming 5th out of 88 competitors. Most recently he competed in the Oryx Quest Round the World Race onboard the 120 foot maxi Catamaran “ Cheyenne ”.
